1. Introduction

Welcome to Koperasi Pintar. These Terms and Conditions ("Terms") govern your use of the Koperasi Pintar application, our website at koperasipintar.id, and related services (collectively referred to as the "Services").

By accessing or using our Services, you agree that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, please do not use our Services.

Be responsible for the actions and omissions of such users

4. Use of Services

Complying with all applicable laws and regulations regarding financial transactions
Paying all applicable taxes and fees related to your transactions
Maintaining adequate records of all transactions for accounting and reporting purposes

5.2 Blockchain Technology

Our Services use blockchain technology to record and verify transactions. By using the Services, you acknowledge and agree that:

Transactions recorded on the blockchain are permanent and immutable
While we take measures to protect personal information, some transaction data may be visible to other blockchain network participants
We are not responsible for delays, errors, or failures caused by blockchain network issues beyond our control
You will use blockchain features in accordance with the guidelines and best practices we provide

The Services and all content, features, and functionality contained therein (including but not limited to text, graphics, logos, icons, images, audio clips, video, and software) are owned by Koperasi Pintar, its licensors, or other content providers and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

If you provide suggestions, ideas, or feedback to us regarding the Services ("Feedback"), you grant us an irrevocable, royalty-free, worldwide right to use such Feedback without compensation or attribution to you.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. KOPERASI PINTAR EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, THAT THE SERVICES WILL BE AVAILABLE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE.

8. Limitation of Liability

IN NO EVENT SHALL KOPERASI PINTAR, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

YOUR USE OR INABILITY TO USE THE SERVICES
UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA
STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICES
RESULTS OF THE SERVICES
VIRUSES OR OTHER MALICIOUS CODE THAT MAY INFECT YOUR DEVICE AS A RESULT OF ACCESSING THE SERVICES OR DOWNLOADING CONTENT FROM THE SERVICES

THESE LIMITATIONS SHALL APPLY NOTWITHSTANDING THE FAILURE OF THE ESSENTIAL PURPOSE OF ANY LIMITED REMEDY AND TO THE FULLEST EXTENT PERMITTED BY LAW.

You agree to defend, indemnify, and hold harmless Koperasi Pintar, its affiliates, directors, employees, agents, and licensors from and against any and all claims, damages, liabilities, losses, responsibilities, costs, or debts, and expenses (including but not limited to attorney's fees) arising from:

Your use and access of the Services
Your violation of these Terms
Your violation of any third party rights, including but not limited to copyright, property, or privacy rights
Content that you upload, post, or share through the Services

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Indonesia, without regard to its conflict of law provisions. Any legal action or proceeding arising from or relating to these Terms or the Services shall be settled exclusively in the courts located in Jakarta, Indonesia, and you agree to submit to the jurisdiction and venue of such courts.

11. Changes to Terms and Conditions

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Services.

1. Pendahuluan

Selamat datang di Koperasi Pintar. Syarat dan Ketentuan ini ("Syarat") mengatur penggunaan Anda atas aplikasi Koperasi Pintar, situs web kami di koperasipintar.id, dan layanan terkait (secara kolektif disebut sebagai "Layanan").

Dengan mengakses atau menggunakan Layanan kami, Anda menyetujui bahwa Anda telah membaca, memahami, dan menyetujui untuk terikat oleh Syarat ini. Jika Anda tidak setuju dengan Syarat ini, harap jangan gunakan Layanan kami.

Kami dapat mengubah Syarat ini dari waktu ke waktu. Perubahan akan efektif setelah kami memposting Syarat yang direvisi di platform kami. Penggunaan Anda yang berkelanjutan atas Layanan setelah perubahan tersebut merupakan persetujuan Anda terhadap Syarat yang direvisi.

2. Definisi

"Koperasi Pintar", "kami", "kita", atau "milik kami" mengacu pada penyedia Layanan Koperasi Pintar.
"Anda" atau "Pengguna" mengacu pada individu atau entitas yang mengakses atau menggunakan Layanan.
"Koperasi" mengacu pada organisasi koperasi yang menggunakan Layanan kami untuk mengelola operasinya.
"Anggota" mengacu pada individu yang terdaftar sebagai anggota koperasi yang menggunakan Layanan kami.
"Konten" mengacu pada semua informasi, data, teks, gambar, grafik, atau materi lain yang diunggah, diunduh, atau muncul di Layanan.
"Blockchain" mengacu pada teknologi buku besar terdistribusi yang digunakan dalam Layanan kami untuk mencatat dan memverifikasi transaksi.

3. Pendaftaran Akun

3.1 Persyaratan Akun

Untuk menggunakan Layanan kami, Anda harus:

Berusia minimal 18 tahun atau usia legal di wilayah hukum Anda
Memberikan informasi yang akurat, lengkap, dan terkini saat mendaftar
Menjaga keamanan kredensial akun Anda
Bertanggung jawab atas semua aktivitas yang terjadi di bawah akun Anda
Segera memberi tahu kami tentang pelanggaran keamanan atau penggunaan yang tidak sah atas akun Anda

3.2 Akun Koperasi

Jika Anda mendaftar atas nama koperasi, Anda menyatakan dan menjamin bahwa Anda memiliki wewenang untuk mengikat koperasi tersebut pada Syarat ini. Anda juga setuju untuk:

Memberikan bukti pendaftaran koperasi yang sah
Memastikan bahwa semua pengguna yang Anda berikan akses mematuhi Syarat ini
Bertanggung jawab atas tindakan dan kelalaian pengguna tersebut

4. Penggunaan Layanan

4.1 Lisensi Terbatas

Dengan tunduk pada kepatuhan Anda terhadap Syarat ini, kami memberikan Anda lisensi terbatas, non-eksklusif, tidak dapat dialihkan, dan dapat dicabut untuk mengakses dan menggunakan Layanan untuk tujuan pengelolaan koperasi Anda.

4.2 Pembatasan Penggunaan

Anda setuju untuk tidak:

Menggunakan Layanan dengan cara apa pun yang melanggar hukum atau peraturan yang berlaku
Menjual, menyewakan, atau menyublisensikan akses ke Layanan
Menyalin, memodifikasi, atau membuat karya turunan dari Layanan
Melakukan rekayasa balik, mendekompilasi, atau membongkar Layanan
Menghapus atau mengubah pemberitahuan hak cipta, merek dagang, atau hak kepemilikan lainnya
Menggunakan robot, spider, scraper, atau cara otomatis lainnya untuk mengakses Layanan
Mengganggu atau mengacaukan integritas atau kinerja Layanan
Mencoba untuk mendapatkan akses tidak sah ke Layanan atau sistem atau jaringan terkait

4.3 Konten Pengguna

Anda bertanggung jawab atas semua konten yang Anda unggah, posting, atau bagikan melalui Layanan. Anda menyatakan dan menjamin bahwa:

Anda memiliki atau telah mendapatkan semua hak, lisensi, persetujuan, dan izin yang diperlukan untuk menggunakan dan mengotorisasi kami untuk menggunakan konten tersebut
Konten tersebut tidak melanggar atau menyalahgunakan hak kekayaan intelektual, privasi, publisitas, atau hak lain dari pihak ketiga mana pun
Konten tersebut tidak mengandung materi yang melanggar hukum, menyinggung, mengancam, memfitnah, mencemarkan nama baik, cabul, atau tidak pantas

5. Transaksi Keuangan dan Blockchain

5.1 Transaksi Keuangan

Layanan kami memungkinkan Anda untuk melakukan dan mencatat berbagai transaksi keuangan terkait koperasi. Anda bertanggung jawab untuk:

Memastikan keakuratan semua informasi transaksi
Mematuhi semua hukum dan peraturan yang berlaku terkait dengan transaksi keuangan
Membayar semua pajak dan biaya yang berlaku terkait dengan transaksi Anda
Mempertahankan catatan yang memadai dari semua transaksi untuk tujuan akuntansi dan pelaporan

5.2 Teknologi Blockchain

Layanan kami menggunakan teknologi blockchain untuk mencatat dan memverifikasi transaksi. Dengan menggunakan Layanan, Anda mengakui dan menyetujui bahwa:

Transaksi yang dicatat di blockchain bersifat permanen dan tidak dapat diubah
Meskipun kami mengambil langkah-langkah untuk melindungi informasi pribadi, beberapa data transaksi mungkin terlihat oleh peserta jaringan blockchain lainnya
Kami tidak bertanggung jawab atas keterlambatan, kesalahan, atau kegagalan yang disebabkan oleh masalah jaringan blockchain yang di luar kendali kami
Anda akan menggunakan fitur blockchain sesuai dengan panduan dan praktik terbaik yang kami berikan

6. Hak Kekayaan Intelektual

6.1 Hak Kami

Layanan dan semua konten, fitur, dan fungsionalitas yang terkandung di dalamnya (termasuk tetapi tidak terbatas pada teks, grafik, logo, ikon, gambar, klip audio, video, dan perangkat lunak) adalah milik Koperasi Pintar, pemberi lisensinya, atau penyedia konten lainnya dan dilindungi oleh hukum hak cipta, merek dagang, paten, rahasia dagang, dan hak kekayaan intelektual atau hak kepemilikan lainnya.

6.2 Umpan Balik

Jika Anda memberikan saran, ide, atau umpan balik kepada kami mengenai Layanan ("Umpan Balik"), Anda memberikan kepada kami hak yang tidak dapat dicabut, bebas royalti, dan berlaku di seluruh dunia untuk menggunakan Umpan Balik tersebut tanpa kompensasi atau atribusi kepada Anda.

7. Penafian Jaminan

LAYANAN DISEDIAKAN "SEBAGAIMANA ADANYA" DAN "SEBAGAIMANA TERSEDIA" TANPA JAMINAN APA PUN, BAIK TERSURAT MAUPUN TERSIRAT. KOPERASI PINTAR SECARA TEGAS MENAFIKAN SEMUA JAMINAN DARI JENIS APA PUN, BAIK TERSURAT MAUPUN TERSIRAT, TERMASUK TETAPI TIDAK TERBATAS PADA JAMINAN TERSIRAT TENTANG KELAYAKAN UNTUK DIPERDAGANGKAN, KESESUAIAN UNTUK TUJUAN TERTENTU, DAN NON-PELANGGARAN.

KAMI TIDAK MENJAMIN BAHWA LAYANAN AKAN MEMENUHI PERSYARATAN ANDA, BAHWA LAYANAN AKAN TERSEDIA TANPA GANGGUAN, TEPAT WAKTU, AMAN, ATAU BEBAS DARI KESALAHAN, ATAU BAHWA HASIL YANG MUNGKIN DIPEROLEH DARI PENGGUNAAN LAYANAN AKAN AKURAT ATAU DAPAT DIANDALKAN.

8. Batasan Tanggung Jawab

DALAM KEADAAN APA PUN, KOPERASI PINTAR, AFILIASI, DIREKTUR, KARYAWAN, AGEN, ATAU PEMBERI LISENSINYA TIDAK BERTANGGUNG JAWAB ATAS KERUSAKAN TIDAK LANGSUNG, INSIDENTAL, KHUSUS, KONSEKUENSIAL, ATAU PUNITIF, TERMASUK TETAPI TIDAK TERBATAS PADA, KEHILANGAN KEUNTUNGAN, DATA, PENGGUNAAN, NIAT BAIK, ATAU KERUGIAN TIDAK BERWUJUD LAINNYA, YANG DIHASILKAN DARI:

PENGGUNAAN ANDA ATAU KETIDAKMAMPUAN UNTUK MENGGUNAKAN LAYANAN
AKSES TIDAK SAH KE ATAU PERUBAHAN TRANSMISI ATAU DATA ANDA
PERNYATAAN ATAU PERILAKU PIHAK KETIGA MANA PUN DI LAYANAN
HASIL DARI LAYANAN
VIRUS ATAU KODE BERBAHAYA LAINNYA YANG MUNGKIN MENGINFEKSI PERANGKAT ANDA SEBAGAI AKIBAT DARI MENGAKSES LAYANAN ATAU MENGUNDUH KONTEN DARI LAYANAN

BATASAN INI AKAN BERLAKU TERLEPAS DARI KEGAGALAN TUJUAN ESENSIAL DARI SETIAP PEMULIHAN TERBATAS DAN SEJAUH YANG DIIZINKAN OLEH HUKUM.

9. Ganti Rugi

Anda setuju untuk membela, mengganti rugi, dan membebaskan Koperasi Pintar, afiliasi, direktur, karyawan, agen, dan pemberi lisensinya dari dan terhadap setiap dan semua klaim, kerusakan, kewajiban, kerugian, tanggung jawab, biaya, atau hutang, dan pengeluaran (termasuk tetapi tidak terbatas pada biaya pengacara) yang timbul dari:

Penggunaan dan akses Anda ke Layanan
Pelanggaran Anda terhadap Syarat ini
Pelanggaran Anda terhadap hak pihak ketiga, termasuk tetapi tidak terbatas pada hak cipta, properti, atau hak privasi
Konten yang Anda unggah, posting, atau bagikan melalui Layanan

10. Hukum yang Berlaku

Syarat ini akan diatur dan ditafsirkan sesuai dengan hukum Indonesia, tanpa memperhatikan ketentuan konflik hukumnya. Setiap tindakan hukum atau proses yang timbul dari atau terkait dengan Syarat ini atau Layanan akan diselesaikan secara eksklusif di pengadilan yang berlokasi di Jakarta, Indonesia, dan Anda setuju untuk tunduk pada yurisdiksi dan tempat pengadilan tersebut.

11. Perubahan pada Syarat dan Ketentuan

Kami berhak, atas kebijakan kami sendiri, untuk mengubah atau mengganti Syarat ini kapan saja. Jika revisi bersifat material, kami akan memberikan pemberitahuan setidaknya 30 hari sebelum Syarat baru berlaku. Apa yang merupakan perubahan material akan ditentukan atas kebijakan kami sendiri.

Dengan terus mengakses atau menggunakan Layanan kami setelah revisi tersebut berlaku, Anda setuju untuk terikat oleh Syarat yang direvisi. Jika Anda tidak setuju dengan Syarat baru, harap hentikan penggunaan Layanan.
